Zinake Social

Effective Date: 1st January 2026

These Terms and Conditions (“Terms”) govern your access to and use of Zinake Social (“Zinake”, “we”, “our”, or “us”), a social media management platform that allows users to manage multiple social media accounts in one place through a subscription or by assigning social media management to Zinake.

By accessing or using Zinake Social, you agree to be bound by these Terms. If you do not agree, you must not use the platform.


1. Definitions

  • “Platform” means the Zinake Social website, application, and related services.

  • “User”, “you”, or “your” means any individual or entity using Zinake Social.

  • “Subscription” means a paid or free plan granting access to platform features.

  • “Delegated Management” means assigning social media account management to Zinake.

  • “Content” means text, images, videos, posts, captions, and other material uploaded or managed through the platform.


2. Eligibility

You must:

  • Be at least 18 years old, and

  • Have legal authority to manage or grant access to the social media accounts you connect to Zinake Social.

By using the platform, you confirm that you meet these requirements.


3. Account Registration

To use Zinake Social, you must create an account and provide accurate, current information.

You are responsible for:

  • Maintaining the confidentiality of your login credentials

  • All activities performed under your account

Zinake Social is not responsible for unauthorized access resulting from your failure to secure your credentials.


4. Services Provided

Zinake Social provides:

  • Centralized management of multiple social media accounts

  • Content scheduling and publishing

  • Analytics and reporting tools

  • Social media management services where delegated by the user

Specific features depend on your selected subscription plan.


5. Delegated Social Media Management

Where you assign management to Zinake:

  • You authorize Zinake to access and manage your connected social media accounts

  • Actions are limited to agreed services such as posting, moderation, reporting, or analytics

  • Zinake does not own your social media accounts or content

  • You retain full ownership and responsibility for all content and accounts

Zinake will act in good faith and in accordance with your instructions.


6. User Responsibilities

You agree not to:

  • Use Zinake Social for unlawful, harmful, or fraudulent activities

  • Upload or publish content that violates laws, platform policies, or third-party rights

  • Attempt to disrupt, reverse-engineer, or misuse the platform

  • Use the platform to spam, impersonate, or mislead others

You are solely responsible for ensuring your content complies with applicable laws and social media platform rules.


7. Subscriptions and Payments

  • Some services require payment under a subscription plan

  • Fees are billed in advance and are non-refundable unless stated otherwise

  • Zinake Social may modify pricing with prior notice

  • Failure to pay may result in suspension or termination of services

Payments are processed through secure third-party providers.


8. Intellectual Property

All platform-related materials, including software, designs, logos, and trademarks, are the property of Zinake Social or its licensors.

You are granted a limited, non-exclusive, non-transferable license to use the platform for its intended purpose.

You retain ownership of all content you upload or authorize Zinake to manage.


9. Third-Party Platforms and Integrations

Zinake Social integrates with third-party social media platforms.

Zinake:

  • Is not affiliated with or endorsed by these platforms

  • Is not responsible for changes, restrictions, or outages caused by third-party platforms

  • Does not guarantee continued access if a third-party platform changes its API or policies


10. Suspension and Termination

Zinake Social may suspend or terminate your account if:

  • You breach these Terms

  • You misuse the platform

  • Required payments are overdue

  • Required by law or regulatory authorities

You may terminate your account at any time. Termination does not relieve you of outstanding payment obligations.


11. Data Protection and Privacy

Zinake Social processes personal data in accordance with:

  • The Kenya Data Protection Act, 2019

  • Our Privacy Policy and Cookies Policy

By using the platform, you consent to such processing.


12. Disclaimer of Warranties

Zinake Social is provided on an “as is” and “as available” basis.

We do not guarantee that:

  • The platform will be error-free or uninterrupted

  • Specific business results or social media growth will be achieved

Use of the platform is at your own risk.


13. Limitation of Liability

To the maximum extent permitted by law:

  • Zinake Social shall not be liable for indirect, incidental, or consequential damages

  • Zinake’s total liability shall not exceed the amount paid by you to Zinake in the preceding three (3) months


14. Indemnification

You agree to indemnify and hold harmless Zinake Social from any claims, damages, losses, or expenses arising from:

  • Your use of the platform

  • Your content

  • Your violation of these Terms or third-party rights


15. Changes to These Terms

Zinake Social may update these Terms from time to time. Updates will be posted on the platform with a revised effective date. Continued use constitutes acceptance of the updated Terms.


16. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of Kenyan courts.
